Attorneys for MyPillow CEO Mike Lindell were fined this week for submitting court documents generated with artificial intelligence that contained “nearly thirty defective citations.”
In a 20-page ruling on Monday, U.S. District Judge Nina Wang said attorneys Christopher Kachouroff and Jennifer DeMaster would be fined $3,000 each.
At an earlier pre-trial conference, Kachouroff admitted to filing AI-generated documents without checking them.
“I personally did not check it,” he told the judge.
“If you’re going to use generative artificial intelligence that — that did not excuse you from the obligations of Rule 11,” the judge replied, referring to the Federal Rules of Civil Procedure. Rule 11 state that an attorney certifies there is evidence for factual statements.
“You understood that, correct?”
“Yes, I did, Your Honor,” the attorney said.
Wang blasted both attorneys in the Monday ruling..
“Neither Mr. Kachouroff nor Ms. DeMaster provide the Court any explanation as to how those citations appeared in any draft of the Opposition absent the use of generative artificial intelligence or gross carelessness by counsel,” she wrote.
